Illinois Radon Laws
Did you know we aren’t the only ones who take radon seriously? Illinois has several radon laws in the books. Each Illinois radon law helps to protect home buyers, children & families from the ill effects of radon exposure.
Illinois Radon Law #1
In January of 2008, Illinois put into effect the Illinois Awareness Act. This act requires sellers of a residential property to provide information about indoor radon exposure. They must also disclose the fact that radon is the leading cause of lung cancer in non-smokers, and the second leading cause of lung cancer overall. This law does not require residential properties to be tested for radon prior to the sale. It also not require radon remediation to be performed if a test is done and the results come back high. However, if there has been a radon test done on the home, the seller is required to provide the results with the buyer.
Illinois Radon Law #2
In January 2012, Illinois put into effect a radon law to help protect renters. This new radon law gives people who rent, whether it is an apartment, condo or a single family home the right to access information about radon levels in their home. It also requires the landlord to notify the tenants, before a lease is signed, if the rental space has been tested for radon & whether or not a radon hazard may be present. If a radon test has not been conducted, the renter has the right to conduct either a DIY radon home test kit or hire a professional tester. If the test results show high levels of radon, the renter should inform the lessor in writing. It is recommended that all units below the third level be tested for radon.
